Common questions
Why do I need a will?
A will sets out how your money and assets will be distributed between your nominated beneficiaries. It also names a guardian for your minor children, appoints an executor to administer your estate, and can establish trusts to control how money is managed for young beneficiaries.
Without a valid will, your estate is distributed according to a statutory formula, which may not reflect your wishes.
What is the procedure to have a will drawn up?
- Contact us for a meeting to discuss your needs and take instructions.
- We prepare a draft will and email it to you for review.
- You meet with us a second time to sign your will, which we bind for you.
- You store the will in a safe place.
Usually, documents are prepared within two weeks of our first meeting. Urgent matters can be arranged.
Are there other documents I may need?
Yes. During our meeting we will discuss whether you also need an Enduring Power of Attorney (EPA), an Enduring Power of Guardianship (EPG), an Advance Health Directive (AHD), or testamentary trust provisions.
What do I need to bring to the meeting?
Please bring your identity document, such as a driver's licence. Also bring the full names and residential addresses of the executor you wish to appoint, the guardian of any minor children, your beneficiaries, the attorney under your EPA, and the guardian under your EPG.
How long does it take?
Usually two weeks from our first meeting. Urgent matters can be arranged.

Family Law (Property Matters)
